Divorce, separation and your mortgage and finances

Don't forget the mortgage while you are arguing about the CDs !

If your are reading this page, you may well be contemplating, or in the process of, a divorce or relationship break up and need help to rearrange and separate the finances.

The separation process can be complicated, and often unpleasant (I know - I’ve been there) - BUT, it doesn’t have to be and sometimes the simplest of actions can make the difference.

So why do I want you to call me now ?

Because it will give me a chance to ensure you are in the best possible situation when you are ready to proceed with a mortgage and/or other financial arrangements (many of which I can assist you with later if you so wish - including steps to protect the ability to maintain any maintenance payments involved).

Your actions (and those of your partner) can impact on your credit rating for for many years. In the current financial environment this could prevent you from getting another mortgage, private rental or normal credit facilities.

I will ensure you are aware of the consequences of such actions and help you ‘side step’ the usual pitfalls. Despite the personal turmoil affecting your life at the moment, you can and should take steps to secure your and your family’s future.

I don’t have a magic wand to fix your problems, but I do have a great deal of experience as a mortgage adviser and much of my business involves assisting individuals (and sometimes couples or extended families) to work out how they can afford new living arrangements.

Separating/Divorcing - but the mortgage is still a joint financial commitment

Don’t forget that any joint mortgage is a ‘joint and several liability’ in the eyes of the lender (and the law) - this means that you are both equally liable for the total payments and debt even if you are not living in the property. It is, frankly, much easier to leave the relationship than it is to leave the mortgage!

There are, in many cases (but not all), real benefits in one party ‘taking over the mortgage’ but the ability to do so is totally dependent on the willingness of the lender (or an alternative lender for a remortgage) to accept the remaining owner as meeting their affordability criteria before they release the other party from their liability.

One party keeping the current property avoids or reduces selling costs, legal costs, stamp duty etc - and can go a long way to enabling a reasonable settlement for the departing party. I can work closely with either or both parties to enable the most efficient ‘transfer of equity’ and refinancing - whether in their own right or with the assistance of a new partner of family member as co-borrower or guarantor.

There is no ‘one size fits all solution’ for separation and divorce cases - I encourage you to have an informal chat with me as early as possible in the process so that I can advise you over the financial options available.
